What is Arbitration?

Arbitration is a binding form of dispute resolution in which parties agree to have their dispute decided by one or more independent arbitrators rather than by a court. The arbitrator’s decision — known as an award — is legally enforceable in Thailand and in over 160 countries under the New York Convention.

Thailand has a well-established arbitration framework governed by the Arbitration Act B.E. 2545 (2002). The Thai Arbitration Institute (TAI) and Thailand Arbitration Center (THAC) both offer institutional arbitration services in Bangkok.

We represent clients in arbitration proceedings before TAI, THAC, ICC, SIAC and other institutions — acting for both claimants and respondents across a wide range of commercial disputes.

Our accredited arbitrators also accept appointments as sole arbitrators or panel members. We handle everything from drafting arbitration clauses through to enforcement of awards in Thai courts.

Why Arbitration in Thailand?

Arbitration offers significant advantages over Thai court litigation — proceedings are private, the parties choose their arbitrator, and awards are enforceable in over 160 countries. For international businesses, arbitration is almost always the preferred mechanism for dispute resolution.

Arbitration typically concludes in 12–24 months compared to 3–7 years for Thai court proceedings. The language of proceedings can be English, making it far more accessible for international parties than Thai court litigation.
